REFUND TERMS

This Refund Policy outlines the terms and conditions governing purchases made through www.datavistalogic.com (hereinafter referred to as the “Website”). These terms are provided by DataVista Logic Analytics Inc. (“we”, “us”, or “our”), registered at 250 Yonge Street, Suite 2201 Toronto, ON M5B 2L7, Canada.

By purchasing our digital data analysis services or products, you agree to the terms stipulated below. We strictly adhere to the consumer protection regulations of the United States, the European Union, and the United Kingdom.

1. Digital Products and the Statutory Right of Withdrawal (EU & UK Customers)

Under the consumer protection laws of the European Union and the United Kingdom, consumers generally possess a 14-day right of withdrawal for online purchases. However, an exception applies to the supply of digital content and bespoke digital services.

Explicit Waiver of Withdrawal Rights: Due to the immediate and intangible nature of our digital data analysis products and services, by proceeding with your purchase and consenting to the immediate commencement of the delivery of our digital content, you expressly acknowledge and agree that you waive your 14-day statutory right of withdrawal. Once the digital delivery has commenced, or access to the digital service has been granted, no cancellations or no-reason returns will be accepted.

2. General Refund Eligibility

Given the non-returnable nature of digital data files and analytical services, all sales are considered final. We do not offer refunds, credits, or exchanges for “change of mind” or user error after the service or product delivery has commenced.

Refunds will only be considered under the following strictly defined circumstances:

  • Non-Delivery: If you have not received access to the purchased digital product or service due to a verified technical failure on our platform.
  • Major Defects: If the digital file delivered is demonstrably corrupted or cannot be accessed, and our technical support team is unable to rectify the issue within a reasonable timeframe.
  • Legal Obligation: Where a refund is explicitly mandated by the applicable laws of your specific jurisdiction (e.g., United States consumer protection statutes).

3. Accepted Payment Methods and Refund Processing

We process all transactions securely. The payment methods explicitly accepted on our Website include:

  • Credit and Debit Cards: Visa, Mastercard, and American Express.
  • Digital Wallets (E-Wallets): Apple Pay and Google Pay.

If a refund is authorised by our management team under the conditions outlined in Section 2, the funds will be issued exclusively to the original payment method used during the transaction. Please allow between 5 to 10 business days for the refund to be processed by your bank, card issuer, or e-wallet provider and reflected in your account.

4. Chargebacks and Payment Disputes

We request that you contact our support team to resolve any issues regarding your digital product before filing a dispute or chargeback with your bank, credit card company, Visa, Mastercard, American Express, or e-wallet provider.

Unjustified chargebacks or payment disputes filed for digital goods where delivery has been logged and proven will be contested. In the event of a fraudulent chargeback, DataVista Logic Analytics Inc. reserves the right to permanently suspend your access to our services and submit all relevant delivery logs, server access records, and this agreed-upon Refund Policy to the payment processor (including Stripe) and the respective banking institution as evidence of transaction fulfilment.
